Serbia signed the CRPD in 2009. Persons with disabilities represented 7.96 per cent of the population of Serbia. According to government data, nearly 80 percent of children in institutions in Serbia in 2014 had disabilities, up from 62.5 percent in 2012.

Most children with disabilities in Serbia who are placed in institutions as children remain in state care for their entire lives. The majority have at least one living parent.

The 2006 Law on the Prevention of Discrimination against Persons with Disabilities regulated the general regime for the prohibition of discrimination on the basis of disability, while the 2007 Strategy for the improvement of the position of persons with disabilities defined measures, goals and activities to improve the situation of persons with disabilities. Serbia had made significant steps towards deinstitutionalization, and had undertaken the creation of community-based services. Significant shifts in the area of employment had been made with the adoption in 2009 of the Law on Occupational Rehabilitation and Employment of Persons with Disabilities, which guaranteed the principle of inclusiveness and introduced quotas.
