People with disabilities will be consulted under new local law in Mexico

The members of the Permanent Delegation received the initiative of the Law of Consultation for People with Disabilities for the State and Municipalities of San Luis Potosí, presented by the deputy Martín Juárez Córdova. This law constitutes a legal tool that provides certainty so that the different acts of authority are covered with legality, but above all, with deep respect for Universal Human Rights and compliance with international norms. The initiative was received to establish guidelines for the implementation of public consultation of people with disabilities.

In the State of  San Luis Potosí 5.7% out of every thousand persons have some form of disability, this figure is higher than the national average (5.1%); even with this, the opening and promotion of citizen participation continues to be insufficient.

According to the Convention on the Rights of Persons with Disabilities, (CRPD), in article 4 it establishes that, in the preparation and application of legislation and policies to make it effective, the States Parties will hold “close consultations” and will actively collaborate with people with disabilities, including girls and boys with disabilities, through the organizations that represent them, this implies collaboration with civil society organized around issues that affect people with disabilities.

In San Luis Potosí, the Independent Monitoring Mechanism of the Convention on the Rights of Persons with Disabilities, (CRPD) was mentioned within the State Commission for Human Rights in San Luis Potosí as a tool to promote, protect and supervise the correct application of the CRPD. It is made up of a steering committee, a technical consultation committee (by people from civil society with and without disabilities), a technical secretariat and is chaired by the person who holds the presidency of the State Human Rights Commission, with a total of 15 members.

It is proposed that it be the Independent State Monitoring Mechanism, which is also constituted as a Mechanism for the Consultation of Persons with Disabilities so that it is the one that administers said consultations. The initiative was turned over to the Commission on Human Rights, Equality and Gender, for its analysis.
