
The Executive published on Thursday the Legislative Decree No. 1468, that establishes prevention and protection provisions for people with disabilities during the state of emergency decreed to slow the advance of the new coronavirus in the country.
The norm seeks to guarantee the rights to health, safety, non-discrimination, free development and well-being, information, integrity, autonomy, education, work, participation, among others. This, under conditions of equality and ensuring their due attention at the different levels of government during the quarantine.
People with disabilities have the right to security, protection and access to the provision of basic services that allow them to subsist in a dignified manner, and respecting the exercise of their legal capacity, in the face of the health emergency caused by COVID-19.
For this, all measures are implemented considering the age, gender, intercultural, inclusive, human rights and intersectionality approach; promoting and guaranteeing, as a priority. Two examples of the rules are:
The provision of health services, promoting their accessibility and prohibiting any type of discrimination on the basis of disability, to those who are affected by the health emergency; and in general, the continuity of the services, medical care, including mental health care, rehabilitation and timely delivery of medications related to their pre-existing health conditions must be ensured.
In the case of persons with disabilities who are institutionalized, or residing in residential care centers, residential reception centers, temporary refuge homes, or the like; Or, fulfilling a judicial mandate in some prison establishment, the directors must arrange the necessary adjustments to the physical environments and adopt the corresponding actions.
